General Terms and Conditions

These terms and conditions apply to all reservations, bookings and agreements of rental concluded through Hakuna Matata with care on vacation.
Hakuna Matata with care on vacation mediates the rental of the vacation home on behalf of the owners.
Vacation home, also referred to as vacation home, dwelling or house, means the vacation home, with yard, swimming pool, buildings, contents, as well as all associated other movable and immovable property.
The person making the reservation and booking represents that he/she is authorized to make the rental agreement including the terms and conditions on behalf of all other persons participating in the reservation and booking. The person making the reservation and booking must also be one of the persons occupying the house.
Tenant means the person making the reservation and booking as well as those on whose behalf the reservation and booking is made.
Owner means the owner and those authorized on his behalf.
Landlord means the landlord and those authorized on his behalf.
The manager is the person who manages the vacation home on behalf of the owner.

Reservation and booking

If you have selected a vacation home, please email your chosen date for the period you would like to stay.
We will then personally check if your vacation home is available on the dates you requested. We aim to inform you of this within 1 business day.
If the vacation rental is available, you will receive an email from us with the booking confirmation and invoice. With that, the booking was made. If the vacation rental is not available, we will try to offer you one or more similar vacation rentals. Of course, you are free not to accept this offer.We will send you a confirmation email of the final booking if the full amount is paid within the deadline on the invoice.

Rental price
Once you have selected a vacation home you can find the rental price applicable for your rental period. We strive to work with inclusive prices as much as possible.
By doing so, we want to prevent you from facing all kinds of unexpected additional costs. The rent already includes:
– the cost of final cleaning
– the cost of gas, water and light
– the booking fee In addition, we take care of every booking for you free of charge:
– bedding
– kitchen linen
– towels for drying off after showering and hand washing
– 1 bath towel per person
Rental prices are listed per week. If you are renting for longer than a week (6 nights/7 days), the rent will be prorated. Upon request and for a fee, we can arrange crib(s) and/or high chair(s) for you. The additional cost for this is not yet included in the rental price. There is no cleaning included of your vacation home during your stay. Upon request and for an additional fee, cleaning can be arranged for you at most vacation homes during your stay. If you wish we can inform you about the additional costs on request. In the colder months of the year (November-March), heating costs are not yet included in the price. Heating costs vary by house and are on request. The amount of the deposit is listed in the description of the vacation home. The security deposit must be paid in cash upon arrival and (if no damage is found) will be returned to you in cash upon your departure from the cottage, signed for receipt from both sides.

Payments
After sending the message by email with the booking confirmation and invoice, Hakuna Matata with care on vacation must have received 35% of the rental fee within 7 days. The remaining 65% of the rent must be paid to us no later than 7 weeks before the start of the rental period. For bookings made less than 8 weeks prior to the rental period, the entire amount must be paid at once. For bookings within 5 weeks prior to the rental period, the entire amount must also be transferred urgently. If payments are not made on time, Hakuna Matata with care on vacation is entitled to cancel the reserved, or booked, vacation rentals. Monies already paid are non-refundable.

Travel documents
If the full invoice has been paid, we will send you an email notification approximately 3 weeks prior to the start of the rental period containing the following information:
– key transfer information
– a route description- the contact details of the manager of your vacation home
– additional information

Arrival and departure
On the first day of the rental period you can pick up the key to the property from 4:00 p.m., or if otherwise arranged. The travel documents will tell you where to pick up the key; directions will be included with the travel documents. On the day of departure, you must leave the property by 10:00 a.m. or if otherwise arranged. The vacation home must be delivered to you clean, and you must also leave the home clean again. Dishes should be clean, and trash should be deposited in the designated area.

Security deposit
Hakuna Matata with Care on Vacation then collects and holds the security deposit on behalf of the vacation rental owner. The amount of the deposit is listed with the respective vacation home. If no damage has been found to the vacation home and contents, and on the other hand no additional costs need to be settled, you will receive the deposit back in its entirety; otherwise, the damage and any additional costs will be deducted from the deposit. If everything is in order, the deposit paid in cash upon arrival and (if no damage is found) will be returned to you in cash upon your departure from the vacation home, signed for receipt from both sides. If additional time is needed for final cleaning, the cost of this will be deducted from the deposit. This may occur, for example, if: the vacation home is not left neat and clean, the dishes have not been done, there is litter in or around the house, the garbage has not been taken away to the designated place, etc.

Changes
If you wish to make a change in your reservation or booking, please email a request to us. If we can accommodate your request, we will email you confirmation of the change. The associated costs are at least 39.

Non-availability of the property
If the booked property is not available or will not be available, or will probably not be available during the rental period due to circumstances as a result of which fulfillment by the owner, landlord or Hakuna Matata with care on vacation cannot reasonably be required (as for example in case of: major damage due to fire, major damage due to disaster, major damage due to a burglary, sale of the property, seizure of the property, death of the owner, double booking, etc.), then Hakuna Matata with Care on Vacation is entitled to cancel the contract on the grounds of non-availability of the property. If Hakuna Matata with care on vacation cancels the agreement on the grounds of non-availability of the property, Hakuna Matata with care on vacation can be held liable to the maximum for the refund of the rent already paid. Hakuna Matata with Care on Vacation is expressly not liable for compensation for any damages other than the refund of the rental fee already paid. The renter is not entitled to compensation for damages other than the rental fee already paid to Hakuna Matata with Care on Vacation. If the property is not available, Hakuna Matata with Care on Vacation will attempt to arrange another property for the tenant if possible. If the tenant accepts the new property as a replacement for the unavailable property, then the tenant forfeits any claim for compensation unless otherwise agreed upon at the time of such change.

Cancellation
For current cancellation policies, please refer to the booking sites of your made booking.
We apply the current terms and conditions applicable thereto.

Insurance
It is the responsibility of the renter to be properly insured while on vacation. If necessary, tenants should make their own additional insurance arrangements.

Number of persons
In the description of the vacation homes, the number of people is listed. This is the maximum number of people allowed to stay in the vacation home. Under no circumstances should this number be exceeded unless you have obtained the express permission of Hakuna Matata with Care on Vacation. If this prohibition is violated, the tenant may be denied further access to the property without being entitled to a refund of all or part of the rental fee. In addition, additional charges may be imposed on the tenant. Hakuna Matata with care on vacation are entitled to determine the amount of these additional costs and are also entitled to deduct these additional costs from the deposit.

Pools
Most pools can be used between mid-May and the end of September. However, there are exceptions to this. Hakuna Matata with Care on Vacation is not responsible for pool opening times and dates. Hakuna Matata with care on vacation is not liable for any damage caused by this, or related to it. The pools are maintained from May to the end of September. Unfortunately, something can always go wrong that makes the water in the pool unclear. Hakuna Matata with Care on Vacation is not responsible for unclear water in the pool. It is the tenant’s responsibility to supervise children who may use the pool. Hakuna Matata with Care on Vacation is not responsible for the safety of children who cannot swim properly. If the description of the house does not state that the pool can be fenced, then the pool cannot be fenced.

Pets
Bringing a pet is only possible (for some vacation homes) on request. You should contact Hakuna Matata with care on vacation for this purpose. Most vacation rentals do not allow pets. If it can, it is subject to conditions. Also, there are usually additional costs involved.

Beds
Beds in Portugal tend to be smaller than in the Netherlands. In Portugal, a normal bed length is 1.80 meters. A double bed is usually 1.40 meters wide in Portugal. Unfortunately, we cannot change this. In Portugal, people (in general) are smaller than in the Netherlands with the result that beds are also smaller. We consider this to be common knowledge information. If you wish to rent a house in which there are larger beds, please let us know prior to booking. If you select a house prior to booking, you can request from us what the bed sizes are. We will then obtain the measurements for you and inform you accordingly. Once your booking is established, the booking cannot be canceled due to too small beds. We also cannot take complaints about beds that are too small.

Price change
Hakuna Matata with care on vacation is entitled to change the rental prices as published on the website at any time. If a rental price of a vacation home already booked is increased this does not result in the obligation of the tenant who has already booked the home to pay the difference. If a rental price of a vacation home already booked is reduced, this will not result in Hakuna Matata’s obligation with Care on Vacation to refund the difference to the tenant who has already booked the home.

Tenant obligations
The tenant has a duty of care for the vacation home. The tenant must leave the vacation rental in the same condition as he found it at the beginning of the rental period. The tenant is expected to inspect the vacation home upon arrival. If the tenant notices any damage which was already present at the time of occupying the property, the tenant is obliged to report this damage immediately to the manager. If the tenant fails to report this damage and this damage was not yet known then the tenant will be held liable. House rules present and/or provided at the vacation home are an indissoluble part of the rental agreement and must therefore be strictly adhered to. It is prohibited at all times, but at least between 10 p.m. and 8 a.m., to cause noise pollution. The violation of this prohibition gives the owner and his agents the right to immediately terminate the rental agreement, without (partial) refund of the rent.

The placing of caravans, campers, tents, and similar items on the land belonging to the vacation home or in its vicinity is expressly prohibited without the prior consent of the owner. Violation of this prohibition gives the owner the right to immediately terminate the rental agreement, without (partial) refund of the rent. It is expressly forbidden to take photographs and/or film recordings of a pornographic nature both inside the vacation homes and in the gardens and grounds belonging to the vacation homes. Violation of this prohibition gives the owner the right to immediately terminate the rental agreement, without (partial) refund of the rent. In addition, it is expressly forbidden to publish in any manner whatsoever photographs and/or film material of a pornographic nature taken and/or recorded in the vacation homes and/or in the gardens and grounds belonging to the vacation homes. If this prohibition is violated, the tenant is liable for any resulting damages. The tenant will allow the owner, the manager and those authorized by one of them to enter the premises belonging to the rented vacation home to do maintenance work. Examples include permitting gardeners and permitting staff to take care of pool cleaning. The tenant will allow the owner and manager to enter the property during the rental period to make necessary repairs. The degree of need is at the discretion of the owner.

Tenant liability
The renter is responsible and fully liable for the rented vacation rental. The tenant will fully reimburse all damage to the property caused by the tenant himself, co-tenants or any visitors, immediately to the owner or manager. Any damage found by the tenant must be reported immediately to the owner or manager. If the damage occurred during the rental period, such damage will be attributed to the renter unless proven otherwise. If these damages exceed the amount of the deposit, the renter is obliged to pay the excess. The determination of damage after the tenant’s departure does not reduce the tenant’s liability. Damage includes damage resulting from, or related to, damage, destruction, breakage, loss, fire, theft, etc. The tenant is responsible for all keys handed to him or her. For the loss of one or more keys, replacement costs are charged per key plus any locksmith fees. If one or more keys to exterior doors are missing, the tenant is also liable for the replacement cost plus the cost of a locksmith. If one or more keys are left on the inside of a door preventing access from the outside, the replacement cost of the locks will be charged plus the cost of a locksmith. There is a television in almost all vacation homes. There is usually even a satellite television. The tenant is not entitled to reset these television channels. If set television channels are lost, a technician will need to visit the vacation home to reset these channels. The renter is liable for the cost of this technician. If the compensation for the damage is not paid in full on site, the renter remains liable for the remaining portion without prejudice. All additional costs, such as collection costs, will also be borne by the tenant. Hakuna Matata with Care on Vacation considers it very important that the renter has taken out third-party insurance.

Liability Hakuna Matata with Care on Vacation
Hakuna Matata with Care on Vacation accepts no liability for loss, theft, damage or injury of any kind caused to or by tenants of properties rented through Hakuna Matata with Care on Vacation. Hakuna Matata with Care on Vacation accepts no liability for loss, theft, damage or injury of any kind caused to or by owners, landlords, managers or their representatives of properties for which Hakuna Matata with Care on Vacation mediates. Hakuna Matata with care on vacation is not liable for damage to tenants’ property during or related to their stay in the rented property. is not liable for damage to property held by tenants during or in connection with their stay in the leased property. Hakuna Matata with care on vacation is not liable for damage to third party property during or related to their stay in the rented property. Hakuna Matata met zorg op vakantie is not liable for damage to property of tenants or third parties caused by the house and its movable and immovable property. Hakuna Matata with care on vacation is not liable for damage to persons during or related to their stay in the rented property. Obvious errors or mistakes in this website, for example regarding the description or rental price of vacation homes, do not bind Hakuna Matata with care on vacation. Hakuna Matata with care on vacation accepts no liability for changes in or around the property, whether made by the owner or caused by other circumstances beyond the control of Hakuna Matata with care on vacation, such as, for example, fire or natural disasters. Hakuna Matata with care on vacation accepts no liability for nuisance caused by construction work in the vicinity of the vacation home. If the tenant is or may become a nuisance as a result of construction work in the vicinity of the vacation home, Hakuna Matata with care on vacation cannot be held liable for the return of the rent, nor for the return of any part thereof, nor for any other damage resulting from this or related to it. Hakuna Matata with Care on Vacation assumes no liability for a misdescribed or incorrectly stated location of a vacation rental. This applies both to the description of the location, and to the display of the vacation home’s location on the map. Displaying the location of a vacation home on the map is only an indication of its location; it does not have to be the exact location. Hakuna Matata with care on vacation assumes no liability for the presence of pests in the vacation home or in the vicinity of the vacation home. Hakuna Matata with Care on Vacation accepts no liability for the inoperability of technical equipment and failure of power and/or water supply. Power and/or water outages are unfortunately common in Portugal, and can sometimes last more than a day. We ask for your understanding in this regard. In any case, no greater damages will be claimed by the renter than the rent paid by the renter plus the booking fee. In any case, no greater damage shall be claimed by the owner, the landlord, the manager and/or their representatives than the rent received or to be received by the landlord.

Complaints
Complaints should be reported to the owner or manager on site. If the complaint is not satisfactorily resolved, please contact Hakuna Matata with care on vacation immediately by phone. We will then make every effort to resolve the complaint as quickly as possible and to everyone’s satisfaction. Should you then still have legitimate complaints, you must submit them in writing immediately during your stay to the owner or the manager on site in the designated complainbook. Otherwise, we cannot take your complaint any further. You must also report the complaint to Hakuna Matata with care on vacation within two weeks upon your return to the Netherlands by registered letter. If you leave the rented vacation rental without prior permission from Hakuna Matata with Care on Vacation, you will lose all rights to any compensation. Furthermore, complaints filed after the termination of the rental period cannot be considered. Hakuna Matata with Care on Vacation is, in any case, liable to the maximum extent of the rental fee.

Indemnification
If Hakuna Matata with care on vacation is held liable and liable for damages, of any nature and extent, to the owner, landlord or manager as a result of or related to the stay of the tenant(s) in the vacation home in which damage to the vacation home, its contents, other property or rights has occurred, the tenant shall indemnify Hakuna Matata with care on vacation from this liability. If Hakuna Matata with care on vacation is held liable and liable for damages, of whatever nature and extent, to third parties as a result of, by or related to the stay of the tenant(s) in the vacation home in which damage to property or rights of third parties have occurred, the tenant shall indemnify Hakuna Matata with care on vacation from this liability.

Applicable law and competent court
Only Dutch law applies to all disputes with Hakuna Matata with care on vacation. All disputes involving Hakuna Matata with care on vacations will be submitted exclusively to the appropriate court in the Netherlands.
